Terms and Conditions

Bonham Prestige – Wedding Photography Services

Agreement

By signing this contract, the client acknowledges and agrees to the terms outlined below. Any modifications to this agreement must be made in writing and agreed upon by both parties. This contract shall be governed by the laws of England and Wales.


Booking Fee and Payment

  1. A non-refundable booking fee of 30% of the total package price is required to secure Bonham Prestige’s services for the agreed date.
  2. The booking fee confirms acceptance of these terms and conditions as published on Bonham Prestige’s website.
  3. The remaining balance must be paid in full no later than 8 weeks before the wedding date. Failure to pay the full amount by this deadline will result in cancellation of services, and Bonham Prestige reserves the right to invoice for time and opportunities lost.
  4. Weddings postponed to a later date will retain the booking fee, provided the Photographer is available for the new date. If unavailable, the booking fee will be forfeited.
  5. Travel costs (calculated at £1 per mile for return journeys) and any accommodation or additional transport expenses will be added to the invoice. These costs will be outlined and agreed upon during the booking process.

Food and Refreshments

  1. For bookings exceeding 6 hours, the client must provide a hot meal and refreshments for the Photographer and their team.
  2. If the venue cannot provide meals, the client must notify Bonham Prestige at least 14 days before the event to allow the team to make alternative arrangements. Additional catering costs may be invoiced if the Photographer needs to self-cater.

Wedding Arrangements

  1. Details of the wedding arrangements must be agreed upon in writing (email is acceptable).
  2. Any changes to the schedule or details must be communicated to Bonham Prestige in writing and acknowledged by the Photographer. The Photographer is not liable for disruptions caused by changes that are not communicated in advance.

Cancellation Policy

  1. Cancellations must be made in writing and will incur the following charges:
    • More than 7 months before the wedding date: The booking fee (30%) will be retained, but no further payments will be due.
    • Within 7 months but more than 3 months before the wedding date: 50% of the total package price will be payable.
    • Within 3 months of the wedding date: 75% of the total package price will be payable.
  2. Any balance already paid beyond the applicable cancellation fee will be refunded.
  3. Bonham Prestige recommends clients secure wedding insurance to protect against unforeseen cancellations.

Coverage and Artistic Licence

  1. Bonham Prestige shall have artistic licence in relation to the poses, compositions, and locations used.
  2. The Photographer’s professional judgment regarding lighting, poses, and the number of images shall be final.
  3. Certain venues may impose restrictions on the Photographer’s movements or use of equipment. Bonham Prestige cannot be held liable for reduced coverage caused by such restrictions.
  4. Due to weather conditions, timelines, or subject cooperation, it may not be possible to capture all requested images.

Additional Hours of Coverage

  1. Additional hours of coverage are available at a rate of £250 per hour if requested in advance or on the wedding day, subject to availability.
  2. For bookings made on the wedding day without prior arrangement, additional hours will be charged at £300 per hour, and payment must be made before delivery of images.

Image Delivery and Retouching

  1. Edited images will be delivered via an online gallery within 6-8 weeks of the event date, unless otherwise agreed.
  2. All images will be adjusted for exposure, brightness, contrast, and sharpness. Any additional retouching or digital manipulation requested by the client may incur additional charges.
  3. Raw files are not provided under any circumstances.

Enhancing Orders

  1. Additional orders for books, prints, and other products must be paid in full prior to delivery.
  2. Prices agreed upon at the time of booking will be guaranteed.
  3. All edited images will be provided digitally for the client. Original files will not be provided.

Display and Promotional Use

  1. The client grants Bonham Prestige permission to use selected images for promotional purposes, including advertising, social media, website galleries, brochures, and sample albums.
  2. Clients wishing to opt out of promotional use must notify Bonham Prestige in writing prior to the wedding day.

Copyright and Usage

  1. The copyright of all images remains with Bonham Prestige under the Copyright, Designs and Patents Act 1988.
  2. The client is granted a personal usage licence for:
    • Printing images for personal use.
    • Sharing images on social media with credit to Bonham Prestige.
  3. Reproduction or distribution of images for commercial purposes is not permitted without prior written consent.

Force Majeure

  1. In the unlikely event that Bonham Prestige is unable to fulfil the terms of this contract due to unforeseen circumstances such as injury, illness, acts of God, terrorism, or any other cause beyond its control, every effort will be made to secure a suitable replacement photographer. If no replacement is available, Bonham Prestige’s responsibility and liability will be limited to the return of all payments received for the contracted event.
  2. In the rare instance that digital files are lost, stolen, or damaged due to reasons beyond Bonham Prestige’s control—such as equipment malfunction, hard drive failure, or theft—liability will also be limited to a refund of all payments received for the contracted event.
  3. For partial loss of files, liability will be proportionate to the number of images lost in relation to the total delivered.
  4. Bonham Prestige is not responsible for the loss of images beyond the earlier of either the final delivery of all contracted products or one year from the event date.

Limitation of Liability

  1. Neither party shall be held liable for indirect or consequential losses arising from any failure under this agreement.

Complaints

  1. Any complaints must be raised in writing to Bonham Prestige within 28 days of the client becoming aware of the issue or, in any event, no later than 28 days after receipt of the final images.
  2. Bonham Prestige will make every effort to resolve complaints promptly and amicably in accordance with the terms of this agreement.

Travel and Accommodation

  1. Travel expenses will be charged at £1 per mile for return journeys.
  2. For locations exceeding two hours’ drive from Bonham Prestige’s base, reasonable accommodation costs will apply and will be pre-agreed with the client.
  3. Air or rail transport and associated baggage fees, where necessary, will be invoiced as additional costs.

Prints, Reorders, and Albums

  1. Orders for prints, reorders, or albums must be made in writing.
  2. Bonham Prestige is not responsible for errors in print orders unless the instructions are provided in writing.

Personal Accident

  1. Any directions given to clients or guests during a shoot are undertaken at their own risk. Bonham Prestige is not liable for accidents or injuries occurring during photography sessions.

Data Protection

  1. Bonham Prestige will securely store client information and will not share it with third parties without consent.
  2. Personal data will be retained for up to 12 months after the delivery of services, after which it will be securely deleted.
  3. Clients have the right to request access to or deletion of their data at any time.

Governing Law

This agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
